HOUSE BILL 439

 

 

AN ACT TO AMEND G.S. 1‑578 SO AS TO PERMIT MOTIONS TO BE HEARD ANYWHERE WITHIN A JUDICIAL DISTRICT.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 1‑578 is hereby amended by striking out the period at the end of the third sentence and adding the following:

", and may be heard in any county of a district by the resident judge or any judge holding courts in the district; provided, no motion may be heard and no orders in the cause may be made outside the county where the action is pending unless notice of motion be served on the opposing party in accordance with the provisions of G.S. 1‑581.".

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after its ratification.
