AN ACT TO AMEND CHAPTER 43, SESSION LAWS OF 1943, RELATING TO THE ELECTION AND TERM OF OFFICE OF THE BOARD OF COUNTY COMMISSIONERS OF CASWELL COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. Section 4 of Chapter 43, Session Laws of 1943, is hereby rewritten to read as follows:

"Sec. 4. If no district is represented on the board of county commissioners by reason of the failure of any person from the district to become a candidate, the board of county commissioners shall appoint some qualified person from the district which has no representative to serve as a member of the board of county commissioners. Should a vacancy occur in the board of commissioners for any other reason, the board of county commissioners shall appoint some person to serve for the unexpired term. Provided, that a member of the board of county commissioners removing his residence from the district he was elected to represent to another district in the county shall not create a vacancy, and such county commissioner shall continue to serve on the board for the duration of his term as the commissioner for the district he was elected to represent."

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be effective as of January 1, 1963.
