AN ACT TO PROVIDE FOR CONTROL OF ROADSIDE ADVERTISING DEVICES ADJACENT TO HIGHWAYS IN POLK COUNTY.

 

The General Assembly of North Carolina do enact:

Section 1. The Board of County Commissioners of Polk County is hereby authorized and empowered to promulgate and enforce regulations governing the erection and maintenance of all roadside advertising devices adjacent to the national system of interstate and defense highways and adjacent to the primary and secondary systems of North Carolina in Polk County.

Sec. 2. In developing regulations under this Act, the Board of Commissioners shall give due consideration to promotion of the safety, convenience and enjoyment of travel on the highway and shall formulate regulations prohibiting advertising devices in protected areas, regulations to provide for signs within protected areas, to provide for certain classes of signs and advertising devices, to provide general rules, regulations and administration, to provide for permits and fees and for the removal of signs according to certain effective dates.

Sec. 3. Rules and regulations of the Board of County Commissioners shall require any person, firm or corporation erecting, maintaining or using a billboard or other structure, poster, sign or other display advertising, to secure a permit from the said Board of Commissioners. Any person, firm or corporation violating the rules and regulations promulgated by the Board of County Commissioners shall be guilty of a misdemeanor punishable in the discretion of the court.

Sec. 4. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 5. This Act shall be in full force and effect from and after its ratification.
