AN ACT TO AMEND CHAPTER 279 OF THE SESSION LAWS OF 1947 AS THE SAME APPLIES TO THE ELECTION OF TOWN COMMISSIONERS IN THE TOWN OF HILLSBOROUGH.

 

The General Assembly of North Carolina do enact:

Section 1. Section 1 of Chapter 279 of the Session Laws of 1947 is amended by rewriting the first sentence thereof to read as follows:

"For the purpose of electing a mayor and commissioners at large, all of the Town of Hillsborough, North Carolina, there shall be held in said town on Tuesday after the first Monday in May, 1967, and biennially thereafter, a nonpartisan election."

Sec. 2. Section 11 of Chapter 279 of the Session Laws of 1947 is hereby amended by rewriting said Section to read as follows:

"In the town election to be held in the year 1967, there shall be elected five commissioners, three commissioners to be elected for terms of four years each, and two commissioners to be elected for terms of two years each. The three candidates receiving the highest number of votes shall be declared elected for the four-year terms, and the two candidates receiving the next highest number of votes shall be declared elected for the two-year terms. In the event a tie vote makes it impossible to determine which candidates have been elected for the four-year terms, the mayor shall designate which have been elected for the four-year terms. In the event there shall be a tie for fifth place as commissioner, then and in that event the town commissioners shall thereupon call and arrange a second election to be held on the fourth Tuesday after the first Monday in May following the election for the purpose of electing an officer as between the two candidates tied for fifth place. That in all elections held subsequent to the elections for the year 1967 commissioners shall be elected for a term of four years. In case of a vacancy in the office of commissioner, the remaining commissioners shall fill the same for the remainder of the unexpired term."

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be effective upon its ratification.
