AN ACT FOR THE NOMINATION AND ELECTION OF MEMBERS OF THE BOARD OF EDUCATION OF CHEROKEE COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. On and after the first Monday in December, 1968, the Board of Education of Cherokee County shall consist of six members to serve for staggered terms of six years each to be nominated and elected as hereinafter provided.

Sec. 2. For the purpose of nominating and electing members of the County Board of Education, the county is hereby divided into three districts, to be numbered and designated as follows: District No. 1 shall be composed of Valley Town Township; District No. 2 shall be composed of Brasstown Precinct, Burnt Meeting House Precinct, Murphy North Ward, Murphy South Ward, Peachtree Precinct and Walker School House Precinct; District No. 3 shall be composed of Culberson Precinct, Grape Creek Precinct, Hanging Dog Precinct, Hot House Precinct, Ogreeta Precinct, Shoal Creek Precinct and Unaka Precinct.

Sec. 3. In 1968, one candidate shall be nominated from District No. 1 and one candidate from District No. 3 by each political party, for election to the County Board of Education. At the general election held for county officers in Cherokee County in 1968, there shall be elected one member of the County Board of Education from District No. 1 and one member from District No. 3, who must be residents of the district they represent. Separate ballots for each district shall be prepared by the County Board of Elections and in the general election, the candidates nominated shall be voted on by only the qualified voters of the district in which the candidates reside.

Sec. 4. In 1970, one candidate shall be nominated from District No. I and one candidate from District No. 2 by each political party for election to the County Board of Education. At the general election held for county officers in Cherokee County in 1970, there shall be elected one member of the County Board of Education from District No. I and one member from District No. 2 who must be residents of the district they represent. Separate ballots for each district shall be prepared by the County Board of Elections and in the general election, the candidates nominated shall be voted on by only the qualified voters of the district in which the candidates reside.

Sec. 5. In 1972, one candidate shall be nominated from District No. 2 and one candidate from District No. 3 by each political party for election to the County Board of Education. At the general election held for county officers in Cherokee County in 1972, there shall be elected one member of the County Board of Education from District No. 2 and one member from District No. 3 who must be residents of the district they represent. Separate ballots for each district shall be prepared by the County Board of Elections and in the general election the candidates nominated shall be voted on by only the qualified voters of the district in which the candidates reside.

Sec. 5. Biennially after 1972 there shall be elected two members to the County Board of Education, as herein provided, to replace the members whose terms next expire.

Sec. 6. All persons elected to the County Board of Education under the provisions hereof shall begin their term of office on the first Monday in December of the year in which elected and shall serve until their successors are duly elected and qualified.

Sec. 7. In order to carry out the provisions of this Act, the term of office of Clarence C. Hemphill shall expire on the first Monday in December, 1968; the term of office of Noah W. Hembree and Dr. Charles 0. Van Gorder shall expire on the first Monday in December, 1970; and the term of office of Lewis King and Robert Stiles shall expire on the first Monday in December, 1972.

Sec. 8. At the first meeting of the County Board of Education after the 1968 general election, said Board shall elect a chairman from its members. In the event of a tie vote for chairman, then each member shall cast for chairman a number of votes equal in number to the total votes cast for all candidates for the Board in his district in the general election. Biennially after 1968, a chairman shall be elected as herein provided.

Sec. 9. The chairman of the County Board of Education shall not be entitled to vote. Four members of the Board shall constitute a quorum.

Sec. 10. Any vacancy occurring on the Board by reason of death, resignation, or otherwise, shall be immediately filled for the unexpired term by the County Executive Committee of the political party causing the vacancy.

Sec. 11. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 12. This Act shall be in full force and effect from and after its ratification.
