AN ACT TO AMEND ARTICLE 4A OF CHAPTER 108 OF THE GENERAL STATUTES TO AUTHORIZE DIRECT PAYMENTS TO NURSING HOMES AND EXTENDED CARE FACILITIES ON BEHALF OF CERTAIN WELFARE RECIPIENTS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 4A of Chapter 108 of the General Statutes is hereby amended by deleting the title "State Boarding Home Fund for the Aged and Infirm", and by inserting in lieu thereof a new title as follows: "Direct Payments for Nursing Care."

Sec. 2.  Article 4A of Chapter 108 of the General Statutes is further amended by deleting the present § 108-79.1, § 108-79.2 and § 108-79.3 and by substituting therefor a single new Section to be designated § 108-79.1 as follows:

"§ 108-79.1.  Payments to Nursing Homes and Extended Care Facilities. The State Board of Public Welfare is hereby authorized and empowered to make payments to duly licensed nursing homes and extended care facilities for persons eligible to receive public assistance under the Old Age Assistance Program or Aid to the Permanently and Totally Disabled Program when nursing care is deemed essential for that person by the State Board of Public Welfare."

Sec. 3.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4.  This Act shall be effective upon ratification.
