AN ACT TO PROTECT THE RETIREMENT BENEFITS OF EMPLOYEES OF FORSYTH COUNTY AND  MUNICIPALITIES THEREIN WHO WILL BECOME STATE EMPLOYEES UPON THE EFFECTIVE DATE OF THE JUDICIAL DEPARTMENT ACT IN SUCH COUNTY.

 

WHEREAS, the Judicial Department Act of 1965 becomes effective in Forsyth County on the first Monday in December, 1968; and

WHEREAS, certain persons who are now employees of Forsyth County and municipalities therein will become State employees on that date; and

WHEREAS, Forsyth County and the City of Winston-Salem are not members of the North Carolina Local Governmental Employees' Retirement System but have independent retirement systems, Forsyth being the only county in North Carolina at the present time that has a retirement system independent of the North Carolina Local Governmental Employees' Retirement System; and

WHEREAS, the Judicial Department Act of 1965 contemplated that county and city employees would not suffer the loss of retirement benefits as a result of being made State employees by State law: Now, therefore,

 

The General Assembly of North Carolina do enact:

 

Section 1. That the Board of Trustees of the North Carolina Teachers' and State Employees' Retirement System is hereby authorized and directed to take such action as is necessary to insure that the employees of Forsyth County and the municipalities therein who become State employees on the first Monday in December of 1968, under the Judicial Department Act of 1965, shall be protected with regard to their retirement benefits. To this end, the officials of the State System and of Forsyth County and the municipalities therein may enter into agreements relating to the retirement status of such employees.

Sec. 2. All laws and clauses of laws in conflict herewith are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after ratification.
