AN ACT AMENDING THE CHARTER OF THE TOWN OF WALLACE IN DUPLIN COUNTY.

 

The General Assembly of North Carolina do enact:

Section 1. Chapter 596, Session Laws of 1949, is amended by adding a new Section thereto, immediately following Section 25, and preceding Section 26, to be designated as Section 25(a)       and to read as follows:

"Sec. 25(a). No action against the Town of Wallace arising in tort shall be maintained unless the person, firm or corporation claiming injury shall plead and prove in court, as a condition precedent to the maintenance of said action, that he, she or it has given written notice to the Town, within 90 days from the occurrence of the facts giving rise to the claim, which notice must:

(a)     Be in writing;

(b)     State the date, place, manner and character of the injury;

(c)     The names and addresses of the person or persons injured;

(d)     The amount of damages claimed;

(e)     Be served by registered or certified mail or by any law enforcement officer of Duplin County or the Town of Wallace on the Mayor or Town Clerk within 90 days from the occurrence of the facts giving rise to the claim."

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after its ratification.
