AN ACT TO AMEND G.S. 160-72 AND G.S. 160-163 TO REMOVE THE LIMITATIONS UPON LIBRARY AND RECREATION TAXES WHICH MAY BE LEVIED WITH VOTER APPROVAL.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 160-72, as the same appears in 1964 Replacement Volume 3D of the General Statutes, is hereby amended by changing the comma in the eighth line of the third paragraph thereof to a period and by striking out all of said paragraph following such period.

Sec. 2.  G.S. 160-72, as the same appears in 1964 Replacement Volume 3D of the General Statutes, is further amended by striking out of the eighth and ninth lines of the fifth paragraph thereof the punctuation and words "within the limitations of this Section".

Sec. 3.  G.S. 160-163, as the same appears in 1964 Replacement Volume 3D of the General Statutes, is hereby amended by rewriting subsection (2) thereof to read as follows:

"(2)      Levy a special tax within such unit for providing, conducting, and maintaining a supervised recreation system; provided, that the maximum tax levy to be submitted to the voters shall be determined by the governing body if it submits the question without receipt of a petition pursuant to G.S. 160‑159, or by the petition requesting such election."

Sec. 4.  G.S. 160-163, as the same appears in the 1964 Replacement Volume 3D of the General Statutes, is further amended by adding at the end thereof a new paragraph to read as follows:

"In any unit in which a tax for recreation purposes has been voted under this Section, or under any other general, public-local, private, or special law, the governing body of such unit may on its own motion, and shall, upon receipt of a petition signed by at least fifteen per cent (15%) of the qualified and registered voters in the unit, submit to the voters of such unit the question of an increase or decrease of such tax. Such question shall be submitted to the voters in the manner provided by this Section."

Sec. 5.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6.  This Act shall be effective upon its ratification.

In the General Assembly read three times and ratified, this the 6th day of June, 1967.
