HOUSE BILL 121

 

 

AN ACT TO PROVIDE THAT A TIE VOTE FOR MEMBERS OF THE GENERAL ASSEMBLY SHALL BE BROKEN BY A SPECIAL ELECTION.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 163-191 is hereby amended by deleting the second sentence of the second paragraph and by inserting in lieu thereof the following: "But if two or more be equal and highest in votes for the office, then the State Board of Elections shall order a new election for the purpose of breaking the tie vote."

Sec. 2.  The last paragraph of G.S. 163-191 is hereby repealed.

Sec. 3.  This act shall become effective July 1, 1971.
