HOUSE BILL 91

 

 

AN ACT PROHIBITING INDECENT EXPOSURE.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Chapter 14, Article 26, of the General Statutes is hereby amended to add the following new section which shall read as follows:

"§ 14-190.9.  Indecent exposure. — Any person who shall willfully expose the private parts of his or her person in any public place and in the presence of any other person or persons, of the opposite sex, or aids or abets in any such act, or who procures another to perform such act; or any person, who as owner, manager, lessee, director, promoter or agent, or in any other capacity knowingly hires, leases or permits the land, building, or premises of which he is owner, lessee or tenant, or over which he has control, to be used for purposes of any such act, shall be guilty of a misdemeanor punishable by a fine not to exceed five hundred dollars ($500.00), imprisonment for not more than six months, or both."

Sec. 2.  Every word, clause, sentence, paragraph, section, or other part of this act shall be interpreted in such manner as to be as expansive as the Constitution of the United States and the Constitution of North Carolina permit.

Sec. 3.  If any word, clause, sentence, paragraph, section, or other part of this act shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof.

Sec. 4.  General Statutes 14-189.2, 14-190, 14-191, and 14-194 are hereby repealed.

Sec. 5.  This act shall take effect upon its ratification.
