HOUSE BILL 1044

 

 

AN ACT TO ALLOW A SPOUSE TO TESTIFY AGAINST THE OTHER SPOUSE IN A TRESPASS ACTION.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 8-57 is amended by inserting after "spouse," in line 13 the following: "or in any criminal prosecution of a spouse for trespass in or upon the separate residence of the other spouse when living separate and apart from each other by mutual consent or by court order,".

Sec. 2.  This act shall become effective upon ratification.

In the General Assembly read three times and ratified, this the 8th day of July, 1971.
