HOUSE BILL 1309

 

 

AN ACT TO AMEND G.S. 45-38 RELATING TO THE RECORDING OF FORECLOSURES OF DEEDS OF TRUST OR MORTGAGES TO ELIMINATE REQUIREMENT THAT WORD "FORECLOSED" BE ENTERED IN ALPHABETICAL GRANTOR/ GRANTEE INDEX.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 45-38 is amended by deleting the last sentence thereof which reads as follows: "There also shall be entered in the alphabetical indexes kept by the register of deeds, opposite the name of each grantor and grantee to the original deed of trust or mortgage, the word 'foreclosed,' followed by a reference to the book and page of the record notice of foreclosure."

Sec. 2.  This act shall become effective upon ratification.

In the General Assembly read three times and ratified, this the 20th day of July, 1971.
