HOUSE BILL 744

 

AN ACT TO PROHIBIT THE SETTING OF STEEL TRAPS ON CERTAIN RENTED OR LEASED LAND IN CLEVELAND, POLK, AND RUTHERFORD COUNTIES.

 

The General Assembly of North Carolina enacts:

 

Section 1.  It shall be unlawful in Cleveland, Polk, and Rutherford Counties for any person, firm or corporation to set or possess any steel trap of any type or take any animal caught in any steel trap, on any lands, except as hereinafter provided.

Sec. 2. It shall be lawful for any person, firm or corporation to set or possess steel traps and take animals therefrom, provided not otherwise prohibited by law, on his own land, or on lands which have been leased solely for agricultural purposes.

Sec. 3. It is the intent and purpose of this act to prohibit any person, firm or corporation from setting or using steel traps of any type on lands in Cleveland, Polk, and Rutherford Counties which have been leased or sublet from some other person, firm or corporation, except lands which have been leased solely for agricultural purposes.

Sec. 4. Violation of this act shall be a misdemeanor punishable by a fine of not less than fifty dollars ($50.00) or more than two hundred dollars ($200.00), or by imprisonment for not more than 30 days or by both fine and imprisonment, in the discretion of the court.

Sec. 5. This act shall become effective upon ratification.
