AN ACT TO PRORATE THE PROPERTY TAX LIABILITY OF AN OWNER OF LAND WHICH IS SUBSEQUENTLY CONDEMNED BY THE STATE OR ANY LOCAL MUNICIPALITY VIA EMINENT DOMAIN.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Article 9 of Chapter 136 of the General Statutes is hereby amended by adding a new section thereto to be numbered and to read as follows:

"§ 136-121.1.  A property owner whose property is totally taken in fee simple by any condemning agency (as defined in G.S. 133-7(1)) exercising the power of eminent domain, under this Chapter or any other statute or charter provision, shall be entitled to reimbursement from the condemning agency of the pro-rata portion of real property taxes paid which are allocable to a period subsequent to vesting of title in the agency, or the effective date of possession of such real property, whichever is earlier."

Sec. 2.  This act shall become effective January 1, 1976.
