HOUSE BILL 1307

AN ACT RELATING TO LEARNED TREATISES AND THE HEARSAY RULE.

The General Assembly of North Carolina enacts:

Section 1.  In all actions in the superior court to the extent called to the attention of an expert witness upon cross-examination or relied upon by him in direct examination, the hearsay rule shall not exclude statements contained in published treatises, periodicals, or pamphlets on a subject of history, medicine, or other science or art, established as a reliable authority by the testimony or admission of the witness or by other expert testimony or by judicial notice, even though the declarant is available as a witness. If admitted, the statements may be read into evidence but may not be received as exhibits unless agreed to by counsel for the parties.

Sec. 2.  This act shall become effective July 1, 1977.
