GENERAL ASSEMBLY OF NORTH CAROLINA

CHAPTER 138
The General Assembly of North Carolina enacts:
Section 1. It is unlawful to use gill netting, dynamite or any other explosive device in the taking of fish or other water creatures on Lake Santeetlah in Graham County, Fontana Lake in Graham and Swain Counties, Cheoah Lake in Graham and Swain Counties, or Calderwood Lake in Graham and Swain Counties.
Sec. 2. Violation of this act is a misdemeanor punishable for a first conviction by a fine of not more than five hundred dollars ($500.00) and the replacement cost of the fish or other water creatures, or by imprisonment not to exceed three months, or both, and punishable for a second or subsequent conviction by a fine of not less than five hundred dollars ($500.00) and the replacement cost of the fish or other water creatures, and confiscation of any boat or other equipment used in conjunction with the prohibited activity, or by imprisonment not to exceed one year, or both.
Sec. 3. This act is enforceable by law enforcement officers of the Wildlife Resources Commission, by sheriffs and deputy sheriffs, and by other peace officers with general subject matter jurisdiction.
Sec. 4. This act shall become effective October 1, 1989.
