HOUSE BILL 788

 

 

AN ACT to amend the statute governing the powers of water and sewer authorities to allow the authority to set rates for water resources storage or protection programs.

 

The General Assembly of North Carolina enacts:

 

SECTION 1.  G.S. 162A-6 reads as rewritten:

"§ 162A-6.  Powers of authority generally.

(a)        Each authority created hereunder shall be deemed to be a public instrumentality exercising public and essential governmental functions to provide for the public health and welfare, and each authority is authorized and empowered:

(9)        To fix and revise from time to time and to collect rates, fees and other charges for the use of or for the services and facilities furnished by any system operated by the authority;authority, including rates for water stored by the authority through programs to store and protect water resources in the region served by the authority. Schedules of rates, fees, and other charges may vary according to classes of service for programs to store and protect water resources. For purposes of this subdivision, "programs to store and protect water resources" includes aquifer or surficial storage.

SECTION 2.  This act is effective when it becomes law.

In the General Assembly read three times and ratified this the 5th day of June, 2013.
