HOUSE BILL 1084

 

 

AN ACT amending the charter of the city of high point to authorize the city council to delegate to the city manager the authority to dispose of easements that are no longer needed by the city.

 

The General Assembly of North Carolina enacts:

 

SECTION 1.  Chapter 1 of Article IV of the Charter of the City of High Point, being Chapter 501 of the Session Laws of 1979, as amended, reads as rewritten:

"ARTICLE IV.

"ADMINISTRATION.

"CHAPTER 1.

"CITY MANAGER.

"Sec. 4.1.         Appointment; qualifications; term and compensation.

"Sec. 4.2.         Powers and duties.

"Sec. 4.3.         Other duties and procedures.

"Sec. 4.4.         Authority to dispose of easements.

"Sec. 4.4. Authority to dispose of easements. Notwithstanding the provisions of Article 12 of Chapter 160A of the General Statutes, the council may authorize the city manager to dispose of or exchange any of the following property interests in easements when the easement is no longer needed by the city upon such terms as deemed appropriate by the council without obtaining council approval for each disposition: water, sewer, traffic control, drainage, access, sidewalk, greenway, landscape, or utility easements."

SECTION 2.  This act is effective when it becomes law.

In the General Assembly read three times and ratified this the 25th day of June, 2018.
