A BILL TO BE ENTITLED

AN ACT to authorize state and local law enforcement officers to enforce the federal immigration laws to the extent authorized by federal law.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 20 of Chapter 15A of the General Statutes is amended by adding a new section to read:

"§ 15A-407.  State and local enforcement of federal immigration laws.

Notwithstanding any other provision of law, State and local law enforcement officers in this State may perform enforcement functions of federal immigration laws to the extent allowed by federal law and subject to any training requirements and any other limitations or conditions that may be imposed by federal law."

SECTION 2.  There is appropriated from the General Fund to the Department of Crime Control and Public Safety for the 2006-2007 fiscal year the sum of one hundred thousand dollars ($100,000) to provide grants to local law enforcement agencies to implement this act.

SECTION 3.  This act is effective when it becomes law.
