A BILL TO BE ENTITLED

AN ACT to clarify regulation of plants.

The General Assembly of North Carolina enacts:

SECTION 1.  Chapter 106 of the General Statutes is amended by adding a new Article to read:

"Article 36B.

"Regulation of Plants.

"§ 106‑423.10.  Regulation of plants.

The Board of Agriculture shall have sole authority for the banning of plants as defined in G.S. 106‑202.12(7)."

SECTION 2.  This act is effective when it becomes law.
