Short Title:     Study/Buses to Deport Illegal Aliens.

A BILL TO BE ENTITLED

AN ACT TO STUDY ALLOWING SCHOOL, PRISON, AND OTHER BUSES TO BE USED TO TRANSPORT MEXICAN NATIONALS NOT LAWFULLY PRESENT IN THE UNITED STATES BACK TO MEXICO.

The General Assembly of North Carolina enacts:

SECTION 1.  The Commission to Study the Use of School and Prison Buses to Transport Back to Mexico Mexican Nationals Who Are Illegally in North Carolina is created. The Commission shall consist of 22 members as follows:

(1)       The Speaker of the House of Representatives shall appoint:

a.         Six members of the House of Representatives.

b.         One sheriff.

c.         One highway patrol officer.

d.         One school superintendent.

e.         One chief of police.

f.          One official from the Department of Correction.

(2)       The President Pro Tempore of the Senate shall appoint:

a.         Six members of the Senate.

b.         One sheriff.

c.         One highway patrol officer.

d.         One school superintendent.

e.         One chief of police.

f.          One county chief of police.

SECTION 2.  Cochairs. - The Commission shall have two cochairs, one designated by the President Pro Tempore of the Senate and one designated by the Speaker of the House of Representatives from among their respective appointees. The Commission shall meet upon the call of the cochairs.

SECTION 3.  Quorum. - A quorum of the Commission shall consist of 12 members.

SECTION 4.  Vacancies. - Any vacancy on the Commission shall be filled by the original appointing authority.

SECTION 5.  Purpose and Duties. - The Commission shall study the feasibility of using school buses, school activity buses, Department of Correction buses, or buses belonging to any other State agency or local government to transport Mexican nationals found within the State of North Carolina who are not lawfully present in the United States back to Mexico. The study shall also examine the proper means of reimbursing the use of the buses, carrying proper liability insurance, providing adequate food, beverage, and sanitation for those being transported, and making sure that the use of the buses does not interfere with the normal uses of that equipment.

SECTION 6.  Expenses of Members. - Members of the Commission shall receive per diem, subsistence, and travel allowances in accordance with G.S. 120-3.1, 138-5, or 138-6, as appropriate.

SECTION 7.  Staff. - Upon the prior approval of the Legislative Services Commission, the Legislative Services Officer shall assign professional staff to the Commission to aid in its work.

SECTION 8.  Consultants. - The Commission may hire consultants to assist with the study as provided in G.S. 120-32.02(b).

SECTION 9.  Meetings. - The Commission may meet in the Legislative Building or the Legislative Office Building upon the approval of the Legislative Services Commission.

SECTION 10.  Report. - The Commission shall report its findings and recommendations to the General Assembly on or before January 1, 2007, at which time the Commission shall terminate.

SECTION 11.  Funding. - There is appropriated from the General Fund to the General Assembly the sum of thirty thousand dollars ($30,000) for the 2006-2007 fiscal year for the purpose of conducting the study provided for in this act.

SECTION 12.  Effective Date. - This act becomes effective July 1, 2006.
