A BILL TO BE ENTITLED
AN ACT to create an alcoholic beverage control ESTABLISHMENT type called "scenic byways Bed and breakfast inns" and to allow the issuance of certain alcoholic beverage Control permits to a scenic byways bed and breakfast inn without the approval of an election.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 18B‑101 is amended by adding a new subdivision to read:
"(14c) "Scenic byways bed and breakfast inns" means a business of not more than 12 guest rooms that offers lodging accommodations for at least nine but not more than 23 persons and that meets all of the following conditions:
a. It is located in a county with three or more designated scenic byways as designated by the North Carolina Department of Transportation.
b. It operates a kitchen utilizing commercial restaurant equipment and meets the food and beverage requirements of a restaurant as defined in G.S. 18B‑1000(6). The dining area shall feature a seating capacity of 23 or more persons for the purpose of serving food and beverage to guests of the inn and to the general public for pay.
c. It caters on‑site private parties and receptions.
d. It is located in a county in which the on‑premises sale of malt beverages and unfortified wine is authorized in at least two municipalities.
e. It is located in a county where 100 or more businesses have active alcoholic beverage permits issued by the North Carolina Alcoholic Beverage Control Commission.
f. It is located in a county in which the on‑premises sale of malt beverages and unfortified wine is authorized for a competitive bed and breakfast inn or restaurant within a three‑mile radius.
g. It is the permanent residence of the owner or the manager of the business.
A scenic byways bed and breakfast inn shall maintain an Internet Web site to attract travelers and tourists and shall advertise at least quarterly in a state or regional publication or in the State travel guide published by the North Carolina Department of Commerce."
SECTION 2. G.S. 18B‑603(f) is amended by adding a new subdivision to read:
"(10) The permits authorized by G.S. 18B‑1001(1), (3), (5), and (10) for scenic byways bed and breakfast inns."
SECTION 3. This act is effective when it becomes law.
