A BILL TO BE ENTITLED

AN ACT to authorize the legislative research commission to study littering and the enforcement issues regarding that offense.

The General Assembly of North Carolina enacts:

SECTION 1.  The Legislative Research Commission may study littering, the enforcement issues regarding that offense, and ways to make antilitter laws and efforts more effective.  In its study, the Legislative Research Commission may consider the current law regarding littering, including civil remedies and penalties as well as criminal penalties for littering offenses, the detrimental effect that littering has on the State's tourism industry, and the costs to the State for cleaning up litter.  The Commission may consider successful antilitter campaigns and strategies used by other states and any other issues that it deems relevant to the study.  The Commission may make recommendations regarding antilitter strategies and remedies or criminal penalties that may be more effective in addressing litter issues, including any proposed legislation for consideration by the 2007 General Assembly, Regular Session 2008, or by the 2009 General Assembly.

SECTION 2.  The Legislative Research Commission may make an interim report to the 2007 General Assembly, Regular Session 2008, and shall make its final report to the 2009 General Assembly upon its convening.

SECTION 3.  This act is effective when it becomes law.
