A BILL TO BE ENTITLED

AN ACT allowing counties and municipalities to adopt ordinances requiring prepayment of retail motor fuel purchases.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 6 of Chapter 153A of the General Statutes is amended by adding a new section to read:

"§ 153A‑144.  Prepayment of retail motor fuel purchases.

A county may by ordinance require that all retail business establishments with gasoline, diesel, or any other motor fuel pumps located on the premises must require full payment in advance for any quantity of motor fuel sold at any time. The ordinance may require that each retail business establishment and its representatives shall receive payment in full prior to activating the motor fuel pumping device. For the purposes of this section, the term "payment" includes purchase by any legal means using cash, credit card, debit card, checks, or otherwise."

SECTION 2. Article 8 of Chapter 160A of the General Statutes is amended by adding a new section to read:

"§ 160A‑201.  Prepayment of retail motor fuel purchases.

A city may by ordinance require that all retail business establishments with gasoline, diesel, or any other motor fuel pumps located on the premises must require full payment in advance for any quantity of motor fuel sold at any time. The ordinance may require that each retail business establishment and its representatives shall receive payment in full prior to activating the motor fuel pumping device. For the purposes of this section, the term "payment" includes purchase by any legal means using cash, credit card, debit card, checks, or otherwise."

SECTION 3.  This act is effective when it becomes law.
