A BILL TO BE ENTITLED
AN ACT to add employee or agent to the individuals who are prohibited from allowing possession or CONSUMPTION of alcoholic beverages not authorized by permits issued FOR the premises.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 18B‑300(b) reads as rewritten:
"(b) Consumption at Off‑Premises
Establishment. – It shall be unlawful to consume, or for a permittee permittee,
a permittee's agent, or a permittee's employee to allow the consumption of,
malt beverages or unfortified wine on any premises having only an off‑premises
permit for the kind of alcoholic beverage being consumed."
SECTION 2. G.S. 18B‑1006(d) reads as rewritten:
"(d) Unlawful Possession or Consumption. – It shall
be unlawful for a permittee permittee, a permittee's agent, or a
permittee's employee to possess or consume, or allow any other person to
possess or consume, on the licensed premises, any fortified wine or spirituous
liquor, the possession or consumption of which is not authorized either by the
permits issued to him the permittee for the premises or by any
other provision of the ABC law."
SECTION 3. This act becomes effective December 1, 2007, and applies to offenses committed on or after that date.
