A BILL TO BE ENTITLED

AN ACT to implement the federal Lake Mattamuskeet Lodge Preservation Act by providing that the wildlife resources commission shall restore and maintain the lodge in accordance with the north carolina archives and history act and to provide for eligibility under the repairs and renovations reserve account.

Whereas, the Lake Mattamuskeet Lodge Preservation Act, P.L. 109‑358, became law October 16, 2006, and provides for transfer to the State of North Carolina of a parcel of real property consisting of approximately 6.25 acres and containing Mattamuskeet Lodge and surrounding property, including the Mattamuskeet National Wildlife Refuge headquarters; and

Whereas, Section 2(b) of that act provides the transfer is conditional on the State of North Carolina agreeing to restore and maintain the lodge in accordance with Article 1 of Chapter 121 of the General Statutes, the North Carolina Archives and History Act; and

Whereas, the cited North Carolina law generally requires the Department of Cultural Resources to acquire and maintain property; and

Whereas, due to the unique nature of the property, the Wildlife Resources Commission is a more appropriate management agency; and

Whereas, funding from the Repairs and Renovations Reserve Account will best assure stabilization of the property; Now, therefore,

The General Assembly of North Carolina enacts:

SECTION 1.  Article 1 of Chapter 121 of the General Statutes is amended by adding a new section to read:

"§ 121‑9.1.  Lake Mattamuskeet Lodge Preservation.

(a)       Notwithstanding G.S. 121‑9, the State of North Carolina accepts the transfer of the Mattamuskeet Lodge and surrounding property to the State under the Lake Mattamuskeet Lodge Preservation Act, P.L. 109‑358. The property shall be managed by the Wildlife Resources Commission.

(b)       Repair and renovation of the Mattamuskeet Lodge is an eligible expenditure of the Repairs and Renovations Reserve Account under G.S. 143‑15.3A. Any plans for repair and renovation are subject to review by the North Carolina Historical Commission."

SECTION 2.  Effective July 1, 2007, G.S. 121‑9.1(b), as enacted by Section 1 of this act, reads as rewritten:

"(b)      Repair and renovation of the Mattamuskeet Lodge is an eligible expenditure of the Repairs and Renovations Reserve Account under G.S. 143‑15.3A G.S. 143C‑4‑3. Any plans for repair and renovation are subject to review by the North Carolina Historical Commission."

SECTION 3.  This act is effective when it becomes law.
