A BILL TO BE ENTITLED

AN ACT to raise the criminal offense of simple assault on an officer or employee of the state or a political subdivision of the state from a class a1 misdemeanor to a class i felony.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 14‑33(c)(4) is repealed.

SECTION 2.  Article 8 of Chapter 14 of the General Statutes is amended by adding a new section to read:

"§ 14‑33.3. Simple assault on an officer or employee of the State or any political subdivision of the State.

Unless the conduct is covered under some other provision of law providing greater punishment, any person who assaults an officer or employee of the State or any political subdivision of the State, when the officer or employee is discharging or attempting to discharge his or her official duties is guilty of a Class I felony."

SECTION 3.  This act becomes effective December 1, 2009, and applies to offenses committed on or after that date. Prosecutions for offenses committed before the effective date of this act are not abated or affected by this act, and the statutes that would be applicable but for this act remain applicable to those prosecutions.
