A BILL TO BE ENTITLED
AN ACT to limit abc bonuses to personnel at schools that exceed expected growth and to use the savings for salary increases for teachers.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 115C‑105.36(a) reads as rewritten:
"(a) The personnel in
schools that achieve a level of expected growth greater than one hundred
percent (100%) at a level to be high growth, as determined by the
State Board of Education are eligible for financial awards in amounts set by
the State Board. Schools and personnel shall not be required to apply for these
awards. For the purpose of this section, "personnel" includes the
principal, assistant principal, instructional personnel, instructional support
personnel, and teacher assistants (i) serving students in one or more of the
grades kindergarten through 12 or (ii) assigned to a public school
prekindergarten program that is located within a public elementary school and
is designed to prepare students for kindergarten at that school."
SECTION 2. There is appropriated from the General Fund to the Reserve for Compensation Increases the sum of ninety‑three million nine hundred forty‑nine thousand seven hundred thirty‑three dollars ($93,949,733) for the 2009‑2010 fiscal year. Of these funds:
(1) Up to $73,935,064 shall be used for ABC bonuses for schools that exceeded expected growth in the 2008‑2009 school year.
(2) The remainder shall be used to supplement other funds appropriated for teacher salary increases for the 2009‑2010 fiscal year.
This total appropriation equals the amount appropriated in The Current Operations and Capital Improvements Appropriations Act of 2008 for ABC Bonuses.
SECTION 3. This act becomes effective July 1, 2009.
