A BILL TO BE ENTITLED

AN ACT to require contractors that will be compensated by federal economic stimulus funds to use the federal e‑verify system, except as otherwise required by federal law or where necessary in order to ensure receipt of funds.

The General Assembly of North Carolina enacts:

SECTION 1.  Notwithstanding any other provision of law, and except as required by federal law or where necessary in order to receive funds disbursed pursuant to the American Recovery and Reinvestment Act of 2009, Public Law 111‑005, no funds received pursuant to that Act shall be used to enter into a contract with an entity that does not participate in the federal E‑Verify program described in section 401(b) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. § 1324a note).

SECTION 2.  This act is effective when it becomes law.
