A BILL TO BE ENTITLED

AN ACT to prohibit the use of federal economic stimulus funds for illegal aliens, except as otherwise required by federal law or where necessary in order to ensure receipt of funds.

The General Assembly of North Carolina enacts:

SECTION 1.  Notwithstanding any other provision of law, and except as required by federal law or where necessary in order to receive funds disbursed pursuant to the American Recovery and Reinvestment Act of 2009, Public Law 111‑005, funds received pursuant to that Act shall not be disbursed to, or used for the benefit of, persons not lawfully present in the United States. However, the prohibition contained in this section shall not apply to projects or purposes that will merely incidentally benefit persons not lawfully present in the United States.

SECTION 2.  This act is effective when it becomes law.
