A BILL TO BE ENTITLED

AN ACT making a public record any communication by a public officer regarding the qualifications of an applicant for STATE employment or appointment.

The General Assembly of North Carolina enacts:

SECTION 1.  Chapter 132 of the General Statutes is amended by adding a new section to read:

"§ 132‑11.  Public officer communications regarding applicants for public employment.

Notwithstanding any other provision of law, any document or communication produced by a public officer (State or local) with respect to a person seeking a position of public employment or appointment with any State agency to recommend or discourage the employment or appointment of that person is a public record under this Chapter."

SECTION 2.  This act is effective when it becomes law.
