A BILL TO BE ENTITLED

AN ACT to provide that the board of governors of the university of north carolina shall not increase in‑state tuition or certain fees at any constituent institution until august 1, 2010.

The General Assembly of North Carolina enacts:

SECTION 1.(a)  The Board of Governors of The University of North Carolina shall not increase the rate of in‑State tuition or fees under G.S. 116‑143 at any constituent institution from the rate established for the 2008‑2009 fiscal year until August 1, 2010.

SECTION 1.(b)  Subsection (a) of this section does not apply to any fee that is related to existing debt service on a new facility for which the State is obligated to pay debt service.

SECTION 2.  This act is effective when it becomes law.
