A BILL TO BE ENTITLED

AN ACT to make it a misdemeanor offense to label food or food products as kosher or halal without providing the name or contact information of the authority that authorized the designation.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 52 of Chapter 14 of the General Statutes is amended by adding a new section to read:

"§ 14‑401.23.  Labeling as kosher and halal.

(a)        It is unlawful to label any repackaged food or food product or display or to offer for sale any unwrapped food or food product that represents the food or food product as kosher or halal without indicating the person or entity authorizing the designation by providing the name or symbol of the authority or providing a phone number or Web site to access the information.

(b)        Any person who knowingly violates subsection (a) of this section is guilty of a Class 3 misdemeanor."

SECTION 2.  This act becomes effective December 1, 2009, and applies to offenses committed on or after that date.
