AN ACT establishing a right to life at conception.

The General Assembly of North Carolina enacts:

SECTION 1.  Chapter 90 of the General Statutes is amended by adding a new Article to read:

"Article 1K.

"Right to Life at Conception Act.

"§ 90‑21.130.  Short title.

This Article shall be known and may be cited as the Right to Life at Conception Act.

"§ 90‑21.131.  Definitions.

As used in this section, the following terms have the following meanings:

(1) State Constitution. – The North Carolina State Constitution.

(2) Human person or human being. – Includes each member of the species homo sapiens at all stages of life, including the moment of fertilization or cloning, or any other moment at which an individual member of the human species comes into being.

"§ 90‑21.132.  Right to life at conception.

(a) In order to implement equal protection for the right to life of each born and preborn human person, and pursuant to the duty and authority of the General Assembly under the Constitution, the General Assembly hereby declares that the right to life is vested in each human being.

(b) Nothing in this section shall be construed to do any of the following:

(1) Require the prosecution of any woman for the death of her unborn child.

(2) Prohibit in vitro fertilization.

(3) Prohibit the use of birth control or another means of preventing human fertilization."

SECTION 2.  This act becomes effective October 1, 2017.
