AN ACT TO PROVIDE FOR THE CENTRAL REGISTRATION OF MARRIAGE CERTIFICATES.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 7 of Chapter 130 of the General Statutes is amended by adding a new Section immediately following G.S. 130‑52.1, to be designated as G.S. 130‑52.2, and to read as follows:

"G.S. 130‑52.2.  On or before the fifteenth day of each month the registers of deeds of the several counties of this State shall transmit to the Office of Vital Statistics of the State Board of Health in Raleigh, on forms prescribed and furnished by it, a record of each and every marriage ceremony performed in his county during the preceding calendar month, a record of which has been filed in his office as required by applicable law. The form prescribed by the Office of Vital Statistics of the State Board of Health in Raleigh shall contain and set forth in substance the forms and information required by G.S. 51‑16, as amended, as a minimum requirement, and shall be the official form of a marriage license, certificate of marriage, and application for marriage license, issued by the register of deeds. The form so prescribed shall contain additional information in order to conform to the minimum requirements of the National agency in charge of vital statistics. Each form signed and issued by the register of deeds, assistant register of deeds, or deputy register of deeds shall constitute an original or duplicate original. Upon request, the Office of Vital Statistics shall furnish a true copy of any such record, which may be, but is not required to be, photographic, upon the payment to the office of a fee of one dollar ($1.00), and such true copy shall be competent evidence in any court or other proceeding in this State with like force and effect as the original. The moneys received pursuant to this Section shall be paid into the General Fund of the State. The Office of Vital Statistics is authorized to do all things necessary to implement and carry out the provisions of this Section."

Sec. 1 1/2.  There is hereby appropriated to the State Board of Health out of the General Fund of the State the sum of seven thousand five hundred dollars ($7,500.00) for the fiscal year ending June 30, 1962, and the sum of seven thousand five hundred dollars ($7,500.00) for the fiscal year ending June 30, 1963, to be used for carrying out the purposes of this Act.

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall become effective January 1, 1962.
