A BILL TO BE ENTITLED
AN ACT to provide that food items that are products of cloned animals OR THE PROGENY OF CLONED ANIMALS are misbranded and, as such, the persons who manufacture, sell, or deliver such items are subject to civil and criminal penalties and injunctions, unless the food items bear conspicuous labels that identify the food items as being the products of cloned animals OR THE PROGENY OF CLONED ANIMALS.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 106-130 reads as rewritten:
"§ 106-130. Foods deemed misbranded.
A food shall be deemed to be misbranded:
(1) a. If its labeling is false or misleading in any particular, or
b. If its labeling or packaging fails to conform with the requirements of G.S. 106-139 and 106-139.1 of this Article.

(16) If it is a food item, such as a meat, meat product, dairy, or dairy product, that is the product of a cloned animal or the progeny of a cloned animal, unless the food item or, if it is packaged, its packaging when displayed for sale at retail bears a conspicuous label that identifies the food item as being the product of a cloned animal or the progeny of a cloned animal.
(17) If the labelling provided by the manufacturer, packer, distributor, or retailer on a meat, meat product, dairy, dairy product, or any food item that is subject to the labelling requirement under subdivision (16) of this section has been removed, obscured, or altered by any person other than the customer. This subdivision does not prohibit the removal of a label for the purpose of repackaging and relabeling a food item so long as the new package or new label does comply with subdivision (16) of this section."
SECTION 2. This act becomes effective October 1, 2007, and applies to food items sold or offered for sale on or after that date.
