A BILL TO BE ENTITLED

AN ACT to exempt certain activities related to small-scale processing of agricultural products from wastewater permit requirements.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 143-215.1 is amended by adding a new subsection to read:

"(a5)     Notwithstanding subsection (a) of this section, a permit shall not be required for a wastewater management system for the treatment and disposal of wastewater produced from activities related to the processing of agricultural products if all of the following conditions are met:

(1)        The activities related to the processing of the agricultural products are carried out by the owner of the agricultural products.

(2)        The activities related to the processing of the agricultural products produce no more than 1,000 gallons of wastewater per day.

(3)        The wastewater is disposed of by land application.

(4)        No wastewater is discharged to surface waters.

(5)        The disposal of the wastewater does not result in any violation of surface water or groundwater standards."

SECTION 2.  This act is effective when it becomes law.
