A BILL TO BE ENTITLED

AN ACT to make it unlawful for any business to require that a licensed driver relinquish his or her drivers license.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 2A of Chapter 75 of the General Statutes is amended by adding a new section to read:

"§ 75-62.1.  Drivers license protection.

(a)        A business may not require that a person licensed to operate a motor vehicle surrender or relinquish his or her drivers license to the business for any purpose except as provided by subsection (b) of this section.

(b)        When a copy of a person's drivers license is required to be made by law or contract, a business may request and copy the person's license during the regular business hours of the business and must return the drivers license to the person immediately after making the copy.

(c)        A violation of this section is a violation of G.S. 75-1.1."

SECTION 2.  This act is effective when it becomes law and applies as to licensed drivers on or after that date.
