A BILL TO BE ENTITLED

AN ACT TO ALLOW GUILFORD TECHNICAL COMMUNITY COLLEGE TO LEASE A PORTION OF ITS PROPERTY TO THE NORTH CAROLINA CENTER FOR GLOBAL LOGISTICS.

The General Assembly of North Carolina enacts:

SECTION 1.  Notwithstanding G.S. 115D-15, Article 12 of Chapter 160A of the General Statutes, Chapter 66 of the General Statutes, or any other provision of law, the board of trustees of Guilford Technical Community College may lease at private sale to The North Carolina Center for Global Logistics, LLC, a portion of its land and improvements now or hereafter located on the Donald W. Cameron Campus of Guilford Technical Community College.  The terms and conditions of the lease shall be set by the board of trustees of Guilford Technical Community College and may include rental at less than fair market value.  The lease shall not be subject to the prior approval of the State Board of Community Colleges.

SECTION 2.  Notwithstanding G.S. 115D-15 or any other provision of law, the board of trustees of Guilford Technical Community College may use the proceeds of the lease for current operating expenses or for capital outlay purposes.

SECTION 3.  G.S. 66-58(c) is amended by adding a new subdivision to read:

"(c)       The provisions of subsection (a) shall not prohibit:

"(3f)     The use of the personnel and facilities of Guilford Technical Community College, with the consent of the trustees of the college, in support of economic development through the operation of the Donald W. Cameron Campus of Guilford Technical Community College and its companion facilities as an event venue. Proceeds generated shall be used either to pay the operational costs of the college's facilities, to support the event venue, or to support the mission of the college."

SECTION 4.  This act is effective when it becomes law.
