A BILL TO BE ENTITLED
AN ACT to expand the scope of the law that allows an agency acting as a confidential intermediary to obtain a copy of a death certificate of a biological parent or an adult adoptee to include a lineal ascendant of a biological parent when it is determined the biological parent, adult adoptee, or the lineal ascendant of the biological parent is deceased.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 48-9-104(d) reads as rewritten:
"(d) If an agency
providing confidential intermediary services determines that the person who is
the subject of the search is deceased, deceased and upon further
search determines that a lineal ascendant of the person who is the subject of
the search is also deceased, the agency may obtain a copy of the death
certificate of both the deceased person who is the subject of the search and
any lineal ascendant of the person who is the subject of the search pursuant
to G.S. 130A-93 and deliver it to the person who requested the
services."
SECTION 2. This act is effective when it becomes law.
