A BILL TO BE ENTITLED

AN act relating to the remote testimony of child witnesses in  criminal proceedings relating to sexual offenses.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 15A-1225.1 is amended by adding a new subsection to read:

"(b1)    In a criminal proceeding relating to an alleged sexual offense against a child witness, the court may make the determination pursuant to subsection (b) of this section to allow remote testimony by the child witness based solely upon lay testimony."  

SECTION 2.  This act becomes effective October 1, 2011, and applies to criminal proceedings pending on or after that date.
