A BILL TO BE ENTITLED

AN ACT to allow an adult adoptee who is at least forty years of age or older access to a copy of the adult adoptee's original birth certificate.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 48‑9‑106 reads as rewritten:

"§ 48‑9‑106.  Release of original certificate of birth.

(a)        Upon Except as provided in subsection (b) of this section, upon receipt of a certified copy of a court order issued pursuant to G.S. 48‑9‑105 authorizing the release of an adoptee's original certificate of birth, the State Registrar shall give the individual who obtained the order a copy of the original certificate of birth with a certification that the copy is a true copy of a record that is no longer a valid certificate of birth.

(b)        Upon application of an adult adoptee who provides proof of the names of the biological parents of the adult adoptee, the State Registrar shall give the adult adoptee a copy of the adoptee's original certificate of birth with a certification that the copy is a true copy of a record that is no longer a valid certificate of birth. Upon application of an adult adoptee who provides proof of the name of only one biological parent of the adult adoptee, the State Registrar shall give the adult adoptee a copy of the adoptee's original certificate of birth with a certification that the copy is a true copy of a record that is no longer a valid certificate of birth after redacting the name of the parent for which the adult adoptee did not provide proof, if applicable. The State Registrar shall prescribe a reasonable procedure for verifying the identity, age, or other relevant characteristics of an adult adoptee applying for a copy of the adoptee's original birth certificate. In accordance with G.S. 161‑10(a)(8), the fees for issuance of a certified copy of a certificate of birth in this State shall apply to a copy of an adoptee's original certificate of birth issued pursuant to this subsection. This subsection applies only to an adult adoptee seeking an original certificate of birth who is at least 40 years of age or older upon application."

SECTION 2.  This act is effective when it becomes law and applies to applications made on or after that date.
